Please read these Terms of Use (the “Terms”) carefully. These Terms govern your access to and use of the websites operated by TRIUMPH FITNESS INC. (“Triumph,” “we,” “us,” or “our”), including triumphstudio.com, and any related features, products, services, content, and functionality offered through the website (collectively, the “Site”).

By accessing, viewing, downloading, registering for, or otherwise using the Site or any services made available through it, you acknowledge that you have read, understood, and agree to be bound by these Terms.
If you do not agree to these Terms, do not access or use the Site.

Triumph reserves the right, in its sole discretion, to modify these Terms at any time. Any changes will be effective upon posting to the Site. Your continued use of the Site after such changes constitutes acceptance of the revised Terms. It is your responsibility to review these Terms periodically.

IMPORTANT NOTICE: These Terms contain provisions that limit liability, disclaim warranties, and govern dispute resolution.

1. Intellectual Property

All content available on the Site, including but not limited to logos, trademarks, service marks, slogans, text, graphics, images, designs, documents, videos, and software (collectively, the “Site Content”), is owned by Triumph or its licensors and is protected by U.S. and international intellectual property laws.

You may view, download, and print portions of the Site Content solely for your personal, non-commercial use in connection with using the Site. No Site Content may be copied, reproduced, distributed, modified, or used for any commercial purpose without Triumph’s prior written consent.

The TRIUMPH name and all related logos, trade dress, and branding (“Marks”) may not be used in any manner that suggests affiliation, sponsorship, or endorsement by Triumph without express written permission.

2. Eligibility

By using the Site, you represent and warrant that you:

Are at least 18 years old
Have not been previously suspended or removed by Triumph
Are not a direct competitor of Triumph
Have full legal authority to enter into these Terms
Understand that use of the Site is at your own risk

The Site is intended for use within the United States. Users accessing the Site from outside the U.S. do so at their own risk and are responsible for compliance with local laws.

3. User Accounts & Information

You agree to provide accurate, current, and complete information when registering or making purchases through the Site. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

You may not:

Share or transfer your account
Create accounts on behalf of others without authorization
Sell or charge others for access to the Site

Triumph is not responsible for losses resulting from unauthorized account access.

4. User Content

Any information, feedback, reviews, or communications you submit through the Site (“User Content”) must be accurate and lawful and must not infringe the rights of any third party.

Triumph does not control or endorse User Content and is not obligated to monitor or remove it, though we reserve the right to do so at our discretion.

5. Prohibited Conduct

You agree not to:

Use bots, scrapers, or automated tools to access the Site
Upload malware, viruses, or harmful code
Post unlawful, abusive, discriminatory, or obscene material
Infringe intellectual property rights
Interfere with Site functionality or security
Use the Site for fraudulent or unlawful purposes

Triumph reserves the right to investigate and take appropriate action for violations.

6. Memberships, Purchases & Payments

Triumph reserves the right to refuse or cancel memberships, services, or orders at its discretion.

Member Safety & Conduct
Triumph may deny, suspend, or revoke access to the Site, services, or facilities when necessary to:

Protect member safety
Enforce these Terms
Address conduct that violates studio rules, policies, or community standards

This includes, but is not limited to, unsafe behavior, harassment, threats, fraud, or abuse.

Refunds

All membership fees, class packages, and purchases are non-refundable, except as required by applicable law or as expressly stated in writing by Triumph.

Membership Commitments

Most recurring memberships require a minimum four (4) month commitment, unless otherwise specified
Some promotions may require shorter or longer commitments
To cancel, written notice must be provided at least five (5) days prior to the billing date
Late cancellations will result in billing for the next cycle
No partial refunds are provided

Class Cancellations

Classes must be canceled at least 12 hours prior to start time
Late cancellations result in loss of credit
Unlimited memberships may incur a $12 late-cancel fee
No-shows may result in a $15 fee

Cancellations must be confirmed via the app or website. Voicemails do not constitute confirmation.

Promotions

New-member promotions may only be redeemed once every 12 rolling months

VIP Membership Freeze

1-Year VIP memberships may be frozen for up to 90 total days during the 12-month term
No refunds are issued for VIP memberships once processed

7. Waivers & Minors

All fitness services are subject to Triumph’s Participant Waiver, Release of Liability, and Assumption of Risk Agreement. Additional waivers may be required for minors.

8. Indemnification

You agree to defend, indemnify, and hold harmless Triumph and its officers, employees, affiliates, and agents from any claims, damages, liabilities, and expenses arising from your use of the Site, violation of these Terms, or misconduct.

9. Disclaimer of Warranties

The Site and all services are provided “AS IS” and “AS AVAILABLE.” Triumph disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

Triumph does not guarantee uninterrupted or error-free operation and is not responsible for technical issues, data loss, or system failures.

10. Limitation of Liability

To the fullest extent permitted by law, Triumph shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Site or services.

11. Dispute Resolution & Governing Law

These Terms are governed by the laws of the State of Indiana, without regard to conflict-of-law principles.

Any legal action arising out of or relating to these Terms or the Site shall be brought exclusively in the state or federal courts located in Allen County, Indiana. You waive any objections to jurisdiction or venue.

12. Limitation on Claims

Any claim must be brought within one (1) year after the cause of action arises, or it is permanently barred.

13. Termination

Triumph may suspend or terminate access to the Site or services at any time, without notice, for violation of these Terms or to protect its business, members, or community.

14. Third-Party Services

The Site may link to third-party websites or services. Triumph is not responsible for their content, availability, or practices.

15. Use of Third-Party Applications

Triumph uses third-party platforms for payments, scheduling, communications, and operations. Information may be shared as necessary to provide services. Triumph is not required to disclose all third-party vendors.

16. Entire Agreement

These Terms constitute the entire agreement between you and Triumph regarding use of the Site and supersede all prior agreements. If any provision is deemed unenforceable, the remainder shall remain in effect.
